Welcome to the official website of The Preserve Homeowners Association (HOA). By accessing or using this website, making payments, or submitting personal information, you agree to the following policies. These terms are consistent with the North Carolina Planned Community Act (N.C. Gen. Stat. § 47F) and other applicable state laws.

1. Refund and Cancellation Policy

  • Monthly Assessments & Lawn Maintenance Fees: All regular HOA dues and lawn maintenance fees are non-refundable once paid.

  • Advance Payments: Homeowners who prepay assessments may request a refund of any unused advance balance by submitting a written request to the HOA Board. Refunds will be processed within 30 days of approval and, where possible, will be returned via the original payment method.

  • Event Fees/Deposits: Fees or deposits for HOA events are refundable if cancellation is received in writing at least 7 days before the event. Cancellations received after this period are not guaranteed a refund.

  • Third-Party Processing Fees: Any service charges or convenience fees imposed by third-party processors (e.g., credit/debit card, ACH, Apple/Google Pay) are non-refundable.

  • NC Law Compliance: Refund rights under this policy do not limit any protections afforded by North Carolina consumer or contract law.

2. Fulfillment and Shipping Policy

  • The HOA does not sell or ship physical products.

  • All services provided through this website—such as access to announcements, meeting minutes, financial reports, and payment processing—are considered digitally fulfilled at the time of delivery or transaction completion.

  • HOA receipts, confirmations, and official notices may be delivered electronically in compliance with North Carolina Uniform Electronic Transactions Act (N.C. Gen. Stat. § 66-311 et seq.).

3. Terms and Conditions of Website Use

Authorized Use

This website is intended solely for residents, homeowners, and authorized representatives of The Preserve at Ingleside. You agree to use the site only for lawful purposes, including reviewing HOA documents, paying fees, and submitting requests.

Payments

  • By submitting an online payment, you authorize the HOA (or its management company) to collect assessments, event fees, or other charges owed.

  • The HOA is not responsible for technical errors, interruptions, or delays caused by third-party payment processors.
     

Content Accuracy

  • While the HOA strives to provide accurate, timely information, it does not warrant that all posted content (financials, minutes, notices) is error-free. For official confirmation of records, contact the HOA Board or management directly.
     

Disclaimer of Liability

  • The HOA is not liable for damages arising from use or inability to use this website, including but not limited to payment errors, system outages, or unauthorized access, except where liability cannot be waived under North Carolina law.
     

Modifications

  • The HOA reserves the right to amend these Terms at any time. Continued use of the site following posted updates constitutes acceptance.
